Utah strip clubs seek tax relief, mid-July, 2005. SALT LAKE CITY -- Strip clubs and an escort service are stepping up a challenge to a special tax levied by the Utah Legislature a year ago.
Many clubs and escort services have gotten away with not charging the 10 percent tax amid lax state enforcement, and objections to the tax are now headed back to a state district court.
Sex-industry lobbyist and lawyer Andrew McCullough said Thursday he was renewing a legal battle by filing a motion for a preliminary injunction against the cover-charge tax.
McCullough said one of his clients, the strip club American Bush, has been paying the tax in order to challenge it, but many other clubs in Utah are refusing to collect it.
McCullough said he doesn't know of any escort service that is adding the tax to customers' bills.
The tax was supposed to raise $1 million a year for treatment of sex offenders, but the first year's take was less than $5,000, said Tax Commissioner Palmer DePaulis.
Originally a state judge first ruled McCullough's suit was out of his jurisdiction and a matter for the Tax Commission to adjudicate.
But the industry's appeal to the Utah Court of Appeals bounced the case back to 3rd District Judge Tyrone Medley for resolution.

Every Thursday night, these men meet to discuss prostitution and why they were cruising an area like State Street looking for a woman. “I was driving back and forth on State Street, some of the side streets and a gal approached me on one of the side streets asked me for a ride,” said one man enrolled in the program. That was how it started for this john, and he's not unique. The Utah prostitution trade is alive and well. “We do have a problem,” said Robin Snyder, Salt Lake City Police. Detective Snyder says they now run stings every month, posing police officers as prostitutes on State Street or North Temple and catching about 20 johns every time. Detective Snyder says they're also there at other times, just watching. “They want the public to feel safe... Women walking by themselves, if they're approached, they do go stop the man who stops and talks to them and questions them,” said Detective Snyder.
Police say most of the street walkers are drug addicts, charging just enough to feed their addictions. “You get what you want but none of the commitment involved,” said one john. Personal needs kept this man going back to prostitutes for years, even though he knew he was probably helping them get drugs. “A lot of the prostitutes I've been with in the past, it’s not hard to see, they were strung out, and I was supporting that,” he said. But at the time, he didn't care. Then one day, a police officer stopped him after picking up a woman. He was caught, just like the other men attending this class. A number of Salt Lake County cities give men the chance to take the class in lieu of prosecution on their first offense.

The facilitators say this isn't group therapy. But these men say they're leaving with a better understanding of why they went looking for a prostitute and it seems most never do it again, or don't get caught. “It's very seldom we deal with the same guy twice,” Detective Snyder. Around 400 men have gone through the program in the past five years. Prosecutors say fewer than 10 percent have repeated the crime. They fell that is a high success rate, considering that prostitution is a crime that is probably never going to go away.
