Note the following: Police, DA won't discuss anti-prostitution tactics Information could compromise cases, officials say Metro police and the local district attorney general's office this week refused to say to what degree sexual contact between paid confidential informants and prostitutes is still happening now that their differences over the controversial practice have been hammered out. Earlier this year, Davidson County District Attorney General Torry Johnson said several cases had been brought to his attention where it appeared that confidential informants paid by police were engaging in gratuitous sexual behavior after the informant had gathered enough information to make a case. He told the police department he thought such behavior should stop. ''We have met and come to an agreement to work as closely together as we can,'' Metro Deputy Police Chief Steve Anderson said this week. ''Working together, we have (since) conducted some operations that both the police department and the D.A.'s office have agreed on.'' Anderson said he could not get into the specifics of what kinds of sexual contact, if any, had been taken off the table for fear of letting criminals know how to identify the informants. Johnson said his goal was to eliminate ''gratuitous sexual activity'' in the investigations but said he would not go into detail, ''which would compromise investigations.'' ''We want to give them (police) reasonable latitude to produce prosecutable cases while avoiding some of the problems they had gotten into in some cases,'' he said.

If the sexual contact is ''integral to investigation, I don't see that as a huge problem,'' Johnson said. ''Juries understand that prostitution cases involve potentially unsavory facts, circumstances and discussions.'' Metro police paid confidential informants about $70,000 over a three-year period to foster encounters, mostly skin-on-skin, between confidential informants and prostitutes to further Nashville's crackdown on the illicit sex trade, department figures show. Another $50,000 was paid to the prostitutes. The money comes from seizures in other prostitution and gambling cases. In the past, police said they used a variety of tactics to get the informants out of sexual situations without compromising a case. They have declined to give specifics. But those tactics apparently didn't always work to the satisfaction of Metro's chief prosecutor.

''It looked like the crime had been committed, the arrest could have been made or the encounter stopped and that there was no reason for them to go forward,'' Johnson said. Metro police officials agreed with prosecutors that several cases had ''gotten out of hand'' but defended the tactic of allowing paid informants to engage in skin-on-skin contact. Metro police do not maintain figures showing how often informants engaged in various sexual behaviors including intercourse, oral sex and other forms of contact. But court records show a variety of sexual encounters in recent years involving informants.

For example, a 2003 petition to shut down the Music City Motor Inn on Murfreesboro Pike for being a nuisance documents four encounters where a confidential police informant received oral sex from a prostitute in exchange for money. In January 2004, an informant working for police gave a prostitute what appears to be a 33% tip for oral sex, according to court records related to the closure of the Relax Inn on Dickerson Pike. When the informant asked, ''Shea,'' the prostitute, how much she charged, she told him, ''I usually charge $30.00,'' court records say. ''Said 'C.I.' paid 'Shea' $40.00 U.S. currency,'' followed by the sex act. While the tactic of allowing physical contact is distasteful to some, criminals have learned to thwart traditional policing methods, department officials said.

Vice officers say many prostitutes also require customers to strip down, which the department does not let officers do. Police say they have been able to use the informants to build long-term cases and shut down businesses that promote prostitution instead of arresting only individual prostitutes. The few cases where there were problems did not negate the successes that led to the closure of 35 businesses thought to be selling sex, including massage parlors, spas and adult bookstores since April 2002, police said. Authorities also shut down more than 100 phone lines linked to escort services. Despite the fact that the money paid to informants and prostitutes comes from assets seized in criminal investigations, and not government money, police conceded that the funds could go toward other departmental purposes. ''But to say that (funds should be used elsewhere) would be to turn our back on this problem and choose not to deal with it,'' Anderson said. ''Or we'd have to deal with it in another manner using taxpayer funds, which wouldn't be nearly as efficient.'' Similar cases elsewhere •

In August 2004, a circuit judge from Hillsborough County, Fla., threw out a case against a prostitute in which police monitored an informant engaging in a sex act. ''The court finds that the behavior of law enforcement and its agent was so egregious that it violated the defendant's due process rights,'' the judge was quoted as saying in the Tampa Tribune.

• In July 2004, the Courier-Journal newspaper of Louisville, Ky., reported that sexual contact between prostitutes and Jefferson County officers was continuing two years after prosecutors called for the practice to end. • A prosecutor in Phoenix last year refused to prosecute about 60 women who had sexual contact with officers during a sting operation.
