Filming occurred April 1 and 2 at the Nashville Social Club on Division Street and involved more than 240 participants hoping to challenge a national adult film record. More than 6,000 men from across the country were sought to participate through various Internet sites and online swingers groups. Reports of the event touched off phone calls between Metro police and the Davidson County district attorney general's office. ''Our offices have been contacted by Metro (police) but we don't have any actual proof of a crime,'' District Attorney General Torry Johnson said. Under state law, it is illegal to produce obscene material for distribution, Metro police spokesman Don Aaron said. Police did not send officers to investigate the event. ''The information we received was that this was not a public event. It was not an event someone could pay an admission fee and observe.'' Police said they received no complaints during filming. Authorities said they must await information that the event violated obscenity statutes, or involved other criminal activity, such as trading sex for money, drug dealing or illegal sale of alcohol. The state film commission doesn't keep figures on how frequently adult films are produced in Nashville. Clearly, however, Tennessee has not been a significant influence in the pornographic film industry, compared with states such as California, said Jan Austin, deputy director for the state agency. During the past several years, Metro has used civil ordinances and criminal laws to crack down on adult businesses accused of promoting prostitution or creating a nuisance to the community. The campaign has led to the closure of 36 businesses, ranging from massage parlors and strip clubs to adult bookstores. More than 100 telephone numbers associated with illegal escort services were ordered disconnected. Earlier this year, an advertising salesman for a local weekly newspaper was arrested on charges of promoting prostitution after police said he knowingly sold ads to firms that he believed were trying to connect prostitutes with customers. But many adult businesses are protected ''just as long as an adult entertainment business is not engaged in prostitution activity or breaking any laws,'' Metro Law Director Karl Dean said. Lawyer John Herbison, who represents the Social Club and many other local adult businesses, said that attempts to prosecute the filmmakers by using obscenity laws would pose a challenge for authorities. ''It's a minor offense, and it's a misdemeanor. In my 17 years of practicing law, I am not aware of any prosecution of obscenity offenses involving adults or filmmaking.'' To prove the film is obscene, local authorities would have to await completion of the film and then review the final edited version to determine whether the company is distributing a product that meets the three key legal criteria that define obscenity. The film starred adult actress Summer Nyte, 31, of Sevierville, Tenn. Her husband, truck driver David Moore, 42, helped produce the project and said they chose to shoot the film locally because ''Nashville is a nice city.'' ''We called the state attorney's office to make sure we were not doing anything wrong.'' The movie, which also featured adult-film actor Ron Jeremy, involved men ages 21-62 engaging in sex with Nyte. Nyte was the only person paid for taking part, Moore said. Moore and his wife are members of an underworld club of swingers, he said, where consenting adults swap partners for sex. Special Investigations Division detectives and the Metro Legal Department tonight are taking the unprecedented action of shutting down and padlocking four strip clubs for promoting and allowing the commission of prostitution on their properties. While many padlocking orders have been executed in the past involving adult businesses, these are the first involving show clubs.
Babe’s Showclub, 300 McCann Street, The New Club Mirage, 514 8th Avenue South, Showtime, 820 Palmer Place, and Executive Club 701, 701 4th Avenue South, have been declared public nuisances in temporary restraining and padlocking orders signed by Criminal Court Judge Randall Wyatt. Judge Wyatt’s orders prohibit the owners and operators of the businesses and anyone associated with them from setting foot inside the buildings until hearings are held Friday morning.
Tonight’s enforcement actions are part of a continuing collaboration between the Metro Police Department, Metro Legal Department and the District Attorney’s Office to see that adult businesses in Nashville operate in compliance with state and local laws. Since March 2002, the work of the three agencies has resulted in the shutdown of nearly 40 businesses for primarily prostitution-related offenses.
“Show clubs, like other adult businesses, have a right to operate in our city, but must do so within the bounds of the law,” Chief Ronal Serpas said.
“The investigation resulting in tonight’s action dates back to August 2003 and clearly shows that the four businesses have engaged in a pattern of prostitution activity. That activity undermines our city’s tremendous quality of life and presents other health and law enforcement-related issues. It simply will not be tolerated,” Serpas said.
“The primary investigators in these cases are the same ones who have led our organized prostitution enforcement efforts over the past several years. Their work, once again, has been outstanding,” Serpas said.
During the investigation of Babes Showclub, confidential informants working with the police department made prostitution deals with three separate dancers on three separate occasions by paying $200 each time for a 30 minute “V.I.P. dance.” On one of the occasions, a man who identified himself as the manager passed through the V.I.P. room and observed the sex acts, but did not stop them from taking place.
During the investigation of The New Club Mirage, confidential informants working with the police department made a total of seven prostitution deals with six separate dancers on six separate occasions. The money given to the dancers ranged from $60 to $180. On two occasions, male employees of the club were involved in helping arrange the prostitution activity.
During the investigation of Showtime, undercover officers personally observed two acts of prostitution inside the business. Confidential informants working with the police department made a total of seven prostitution deals with a variety of dancers on seven separate occasions. The money given to the dancers ranged from $40 to $140. On several occasions, the dancers were seen giving part of the money to male employees or managers.
During the investigation of Executive Club 701, undercover officers found that they were searched for weapons and recording devices upon entry. Once inside, dancers offered to perform acts of prostitution. They even discussed an “exotic maid service” for $150 per hour, which involved a dancer engaging in prostitution activity in the patron’s home or motel room. Confidential informants working with the police department made six prostitution deals with a variety of dancers on several occasions. Prostitution deals were also made on two occasions at area motels after the “exotic maid service” was called.
The temporary restraining orders against the four businesses tonight follow the September 22 padlocking of Madam X at 701 12th Avenue South. Men were found to perform sex acts on each other while in adjoining booths with large holes in the booth walls. The business was also found to have dancers on the second level who agreed to prostitution deals on four occasions with confidential informants. The money given to the dancers ranged from $60 to $80.
Evidence from all five of the prostitution investigations is expected to be presented to the Davidson County Grand Jury in the near future.

More than 35 businesses have been closed, and 106 phone numbers disconnected. Mongers, do not travel to Nashville or spend a dime there, even to buy gas, if you can possibly avoid it. That investigation had linked 30 Scene ads to prostitution businesses and led to 25 prostitution arrests so far.
