County police refuse to meet with vice force
The Clayton County Sheriff’s Vice Joint Task Force and the Clayton County Police Department could not cooperate long enough to sit in the same room at a meeting scheduled Monday with the district attorney on both of the agencies’ recent spa raids.
The two agencies are, however, working with the district attorney’s office, providing information they hope will lead to Racketeer Influenced and Corrupt Organization Act indictments, and permanently shut down spas suspected of being houses of prostitution.
The county police brought the files from their 14 spa raids to the district attorney Monday morning. They did not come to the scheduled 2 p.m. meeting, because of disagreements with Sheriff Victor Hill.
“I’m not going to sit over there and allow Victor to trivialize my guys’ hard work,” said Interim Police Chief Jeff Turner. “We weren’t too enthused about the sheriff’s comments. He stated that he didn’t need our cases, our good cases.”
Turner said he and the county police are willing to work with District Attorney Jewel Scott and Chief Deputy Assistant District Attorney John Turner, and would give them any information they need to bring indictment’s against the county’s spas.
The vice force officers said they were “kind of surprised” that the county police did not show up. But they spoke with Scott, Turner and Solicitor General Leslie Miller-Terry and were happy with the meeting.
“We handed over our very, very comprehensive investigation and detailed our four-month investigation from start to finish,” said Morrow Police Detective Jimmy Callaway.
The two lead task force detectives, Callaway and Sheriff’s Deputy Michael Johnson, turned over 13 investigation files from the spas they raided on Dec. 8.
The vice force was not able to raid the 14th spa in the county, Callaway said, because it closed down after the county police’s Nov. 30 sting operation.
The raids were not coordinated and each law enforcement agency is accusing the other of trying to get attention, and of not being serious about shutting down the spas.
The police made misdemeanor cases against the women working in the spas and their managers, charging them with soliciting sex acts and operating houses of prostitution.
Hill criticized the county police’s efforts, describing the operation as ineffective, like chopping off limbs of a tree, instead of “chopping the roots to stop this thing.”
A number of warrantless arrests made by the sheriff’s task force during its raid were later dismissed by Magistrate Judge Bobby Simmons for lack of probable cause.
In the dismissal orders, Simmons cited a United States Supreme Court Case, Johnson v. United States, in which the Supreme Court said law enforcement competition could cause officers to violate a person’s rights.
The case states: “The point of the Fourth Amendment, which often is not grasped by zealous officers, is not that it denies law enforcement the support of the usual inferences which reasonable men draw from evidence. Its protection consists in requiring that those inferences be drawn by a neutral and detached magistrate, instead of being judged by the officer engaged in the often competitive enterprise of ferreting out crime.”
Morrow Police Chief Jeff Baker said it was “patently ridiculous” to conclude that competition interfered with the vice force’s investigation and arrests.
“There’s no competition going on... here between anybody,” he said. “Absolutely that’s not the case.”
Baker said he believed the task force officers had probable cause for the warrantless arrest affidavits, even though he said he didn’t know what that probable cause was.
Simmons said in the dismissal order that the warrantless arrest forms did not indicate the vice force had evidence of acts of prostitution “on the date alleged or any other date for that matter.”
“There were only the conclusory statement of the crime, but no facts for this magistrate to rely on to make an independent assessment of their conclusory allegation,” Simmons wrote.
Scott arranged the meeting between the agencies last week, hoping she could use the information gathered from the two raids to bring the spa owners before a grand jury.
“They’ve done the leg work for us to proceed on the RICO indictments,” she said.
Scott said a preliminary reading of the 27 case files from the police and the task force led her to believe there is enough information to indict the spa owners and shut down the spas.
“We feel we have enough to do an action on the RICO statute,” she said. “It didn’t really matter if all three of us could sit down and talk about it. We have enough to present to a grand jury for an indictment.”

Sheriff, county consider combining investigations.
The Clayton County Sheriff’s Vice Joint Task Force is meeting with the Clayton County Police on Monday to see if the agencies can combine their investigations into prostitution at area spas.
“We’re pulling our cases together. We want to work together,” said Morrow Police Detective Jimmy Callaway.
The meeting will also include the Clayton County District Attorney’s Office and will allow the parties to compare notes and see if there are patterns of illegal activity at the spas. They realized that the law enforcement agencies had gathered a lot of useful information in separate raids and may be able to go after spa owners under the Racketeer Influenced and Corrupt Organization Act.
“We’re going to see if they can put all the cards on the table and see if we can get the spas closed, see where we’re at between their investigation and ours,” said County Interim Police Chief Jeff Turner.
The county police and the vice force have both said their goal is to shut down the spas that are allegedly fronts for houses of prostitution, but until this point, the agencies haven’t worked together.
The county police raided several spas along the Tara Boulevard corridor in a simultaneous sting operation on Nov. 30. They arrested business owners and women who allegedly offered undercover officers illegal services, including various sex acts.
According to Turner, it is difficult to bring any charges against the owners of the spas, because the owners will claim the accused prostitutes were acting independently. The alleged prostitutes, facing a misdemeanor charge with a maximum possible sentence of 12 months, will often claim they were acting independently in order to protect their jobs.
Shutting down the spas requires a sustained effort, Turner said.
Sheriff Victor Hill and Morrow Chief Jeff Baker were critical of the county police’s raid, saying it was “very interesting” that the county officers had a sting operation in the middle of the vice task force’s investigation.
Hill has blamed a “Bloods and Crips” mentality (referring to two rival Los Angeles-based gangs) for the lack of cooperation between the sheriff’s department and the county police.
“Had he told us, then that’s something everybody should have been on. He could have let us know, but that’s neither here nor there,” Turner said.
Hill and Baker have emphasized the differences between the police department’s raid and the sheriff’s task force raid. They said the task force raid on Dec. 8 “effectively shut down all illegal spas” in the county, rather than simply arrest prostitutes who may be victims.
However, the vice force used public records from the county police’s Nov. 30 raid as probable cause when seeking warrants for their December raid.
“They did the spa deal and we just pulled the reports that are public records, just to bolster. We didn’t need it, but just to establish a pattern,” Baker said. “It supplements what we do.”
The sheriff’s force got judges to sign 13 search warrants and six arrest warrants the night before the raid. They anticipated arresting the owner of every spa, but did not have the names of the owners from seven of them, Baker said.
During the raid, vice force officers arrested 10 women on charges of keeping a house of prostitution. They had signed warrants for only four of them, but arrested six others without warrants, Baker said.
In a probable cause hearing Monday, Clayton County Magistrate Judge Daphne Walker found that the officers did not have probable cause to make the warrantless arrests.
According to Hill, he and Baker met with Walker this week and learned the arrests were thrown out because of “paper work.”
“There’s a certain way she would like the warrantless arrest forms filled out,” said Hill, who characterized the problem as a small matter than can be fixed easily.
Some of the warrants were signed by Walker between 3:14 and 4:33 a.m., the morning before the raid. The rest of them were signed by a State Court judge at 9:49 a.m., five hours later -- shortly before the raid started.
Hill and Baker said the arrests were not the main point of the operation. The goal was to close the spas and keep them closed ,using seizures, civil action and the RICO Act.
Morrow Police Detective Jimmy Callaway said the task force seized several cars, video surveillance gear, cash, condoms, sex toys, and other evidence. “Just a wealth of stuff for us to build our cases on,” he said.
Hill said he hopes that, even if the women get their arrests overturned and get out of jail, they won’t have businesses to go back to.
Hill and Baker believe it will take a civil lawsuit, or convictions under the RICO Act, to shut down the spas. Both court cases, however, would require evidence of a pattern of illegal activity.
Meeting that legal standard appears to be the driving force behind the willingness of the two police agencies to work together.
“We’re coming to the table and saying, ‘This is what we did and this is what you did.’ We’ll see what we can do to close down these businesses.” Turner said. Owner attempts to rid motel of drugs, prostitution
Mahesh Nichani, owner of the Knights Inn Motel in Norcross, says that he is already in compliance.

NORCROSS — When Mahesh Nichani was looking to invest in real estate six months ago, a 4.5-acre lot just off Interstate 85 and Indian Trail Road seemed like a perfect location.
Nichani claims he was unaware when he bought the 20-year-old Villager Lodge motel — now renamed the Knights Inn — on Brookhollow Parkway that the area was infested with drugs and prostitution. Now a clean-up effort has become his burden, and Nichani feels his motel has been unfairly targeted.
Last month, Nichani was ordered by the Gwinnett County District Attorney’s Office to make repairs and increase surveillance or risk having the motel closed as a public nuisance.
“The problem is not my hotel. The problem is this area that the police need to clean up,” Nichani said.
Nonetheless, Nichani is trying to be a good neighbor and work with Norcross and Gwinnett County police to make a positive change. He has installed 16 security cameras which are monitored in his office. Drug screening and criminal background checks have been completed for all his employees.
A 6-foot privacy fence has been installed around the perimeter of the motel, between the buildings and across the breezeways to discourage residents from loitering and people from wandering in off the street. Nichani also has started keeping a log of people who have been cited for criminal trespass or arrested on the property to serve as a “do not rent” list. There are currently about 150 people on the list.
In all, Nichani figures he has spent about $300,000 to give the place a face-lift, even bringing in a landscaping company and a professional property management company to improve business.
But one of Porter’s demands has been particularly challenging — eliminating loitering on the premises and enforcing rules requiring occupants to keep room doors closed. Monitoring 114 rooms spread across 4.5 acres is a challenge, especially with only one night-time security guard, Nichani said. Nichani also makes frequent rounds on a golf cart during the day to watch for suspicious activity.
“They need to understand that this is an extended stay place,” Nichani said, adding there are about 40 permanent residents.
“Many people call this their home. They are going to come out, they are going to try to make friends in the area. This is like restricting somebody’s freedom.”
Nichani’s goal is to develop the property into a retail shopping center in a few years. He has already hired developer Collier Cauble & Co. to create a retail site plan.

Big News in Savannah! While there has been an increase in the street sceane (probably due to the warmer weather), the cops are out in force.
Saturday and Sunday May 15/16 the cops set up a sting at the Savannah Motor Lodge. I was tipped off about the sting on Saturday when I showed up very late. A girl needed a ride home (no, really, she did) and told me about all of the arrests.
