    Who's responsible in Thailand?

    I was just wondering what everyone else thinks. I've noticed that in Thailand as in the other countries in S.E. Asia, you are responsible for your self and your actions. For instance, at a swimming pool you won't find a long list of rules. If you are stupid enough break a glass by the pool and step on it then it is your fault. If you swim during a thunderstorm and get hit by lightening then it is your fault. If you horse play and get hurt it is your fault. Everything depends on your actions or non actions and not the establishment's.

    If you walk down the street and step into an open sewer hole, it is your fault-- you weren't watching where you were going. Here it would probably be about a 50/50 fault if not 100% fault of the party that left the cover off the manhole.

    While at Kuala Lumpur Int. airport once I saw where some workers and spilled something very slippery on the walkway where passengers ocassionally walk by. No sign, no one there cleaning it up or anything. It stayed that way all night. I know cause I had to spend the night at that airport a few times.

    In Thailand as well as other countries I've seen some constuction sites that were very hazzardess. Workers working with bricks hundreds of feet above while other people walking below with no protection. I've seen welder's welding without safety goggles. There are very few (if any) rules governing their safety.


    Here we have so many rules to control us. We depend on these rules to protect us and so we forget how to protect ourselves.

    Here I think we have learned to shift the blame to someone else. Lawsuits are out of hand. Everyone is suing everyone over anything and everything. Insurance is enormous because of it.

    I know lawsuits have their place and they keep many people in line. But you can go to far sometimes. We as a group have to suffer because of the actions of a few.

    Welcome to the third world or as they say growing economy.When the primary motive is to earn a living & have enough food for your & family.Sueing.. now who's heard of that here ?

    Yes, I'm afraid you are right.

    I read many cases where someone has sued and won a multi-million dollar judgement from a company or doctor (whos insurance will pay). This is more money than the party can possibly spend in a lifetime or really deserves. The judgement has punitive value designed to punish the offender. But who does it end up really punishing?

    Hi. Just got back from LOS! Exactly what Bonman is talking about hit me right away. I saw no evidence of there being building codes, or speed limit signs and yes, if you do something stupid, you can get hurt (or die), but how refreshing to find a population that is thinking for themselves. I really enjoyed the innovative, and practical atmosphere.

    The litigous cancer growing in the west/Europe is preventing progress, which will cause us to lose the economic race with SE Asia. Apart from the effect they have on the rest of the population, just think what we could do if the energy and brainpower of all the accountants and lawyers in North America were retasked to do something productive instead of being overhead and obstructionist.

    Lawyers are not only responsible for holding back the economy (eg: Research in Motion's BlackBerry) but have managed to destroy the integrity of the family unit by shifting power from the Man, to the Woman, and now to the Children!

    The high cost of litigation has driven up insurance rates and hence the product cost. This in turn cause higher wages so people can afford to live and so we have inflation. Asia doesn't have these problems. They can turn out a product in mass very cheaply.

    I know they have other problems with underpaying labor and child labor but for the sake of this arguement it doens't count.

    Of course we have to pay for all these lawsuits, in the UK if you trip on a broken pavement you can sue the local council who then no doubt claim on their insurance ---- but who pays the insurance premiums, the local taxpayers of course.

    Thailand has a cap of 10,000bhat for any civil suit. Even wrongfull death, ie; auto accident. Be damn carefull when you're on a moped!

    Is that all? Just about $250. That would put all the lawyers out of business here.

    Shocked me when i first heard it from my brother(who's lived in pattaya for 10 years) about 5 years ago on my first vist there. Yep, life has a price in Thailand; about 250 bucks. Many a buisness case has been settled on the courthouse steps for the price of a bullet(mostly thai versus thai stuff, shit that rarely makes it to the papers). The locals tell great stories about this subject...
